Terms of use for Line, WeChat, WeCom

For the use of Line/WeChat/WeCom ("APAC electronic communications") between a branch or an affiliate of Deutsche Bank AG, Frankfurt, Germany ("Deutsche Bank" or "Bank") and the customer, the following terms of use shall apply:

1. No financial services, no advice, no instructions and orders

Deutsche Bank does not offer any financial services or advice via the electronic communications platform, in particular (but not limited to) no advice on financial instruments such as shares, funds, etc. as well as on other products and services. The Bank will not accept instructions via the electronic communications platform, e.g. (but not limited to) orders to buy or sell financial instruments, instructions related to loans, transfer orders etc. There will be no separate notice in this regard.

Deutsche Bank does not offer any advice via APAC electronic communications, in particular no advice on financial instruments such as shares, funds, etc. The Bank will also not accept any instructions, e.g., orders to buy or sell financial instruments, via APAC electronic communications. There will be no separate notice in this regard.  The Bank will also not offer any other financial services via APAC electronic communications and will not accept any other orders from the customer, e.g., transfer orders, via APAC electronic communications.

2. Opt-in/Opt-out

Opt-in

the Bank will send the customer an APAC electronic communication to the customer's stored mobile telephone number in which the customer must agree to these Terms of Use for the use of APAC electronic communication between the Bank and the customer.  The customer's continued use of APAC electronic communications to communicate with the Bank shall be conclusively deemed to constitute the customer’s consent and agreement to communicate with the Bank via APAC electronic communications and to these Terms of Use.

Opt-out

The customer may revoke its consent to these Terms of Use at any time by sending a message to the Bank with the words "OPT OUT". By revoking the consent, communication via APAC electronic communications will be terminated. After such an opt-out, a renewed opt-in will require the customer to initiate a new APAC electronic communication to the Bank.

3. Confidentiality

APAC electronic communications may contain confidential or privileged information. Any unauthorized copying, disclosure or dissemination of information in such a communication is strictly prohibited. If the customer is not the intended recipient of a message, the customer must notify the Bank immediately and the message in question must be deleted without delay by the customer.

4. Monitoring and Retention

In order to monitor compliance with legal and regulatory obligations as well as Bank policies, procedures and compliance measures, Deutsche Bank reserves the right to review and record the content of all APAC electronic communications exchanged with representatives of the Bank to the extent permitted by applicable laws and regulations. This may include personal information and customer information. The Bank will make and retain copies of APAC electronic communications and information exchanged through APAC electronic communications to comply with, and as permitted by, applicable laws and regulations.

5. Data protection

When a customer communicates with the Bank via the APAC electronic communications platform, the Bank may receive personal information about that customer or third parties ("Personal Information"). Deutsche Bank may use such Personal Information in connection with providing banking and other financial services and products to the customer or when the Bank acts in its legitimate interests or is complying with regulatory or other legal obligations. Deutsche Bank will retain Personal Information during the banking relationship with the customer and to the extent permitted by applicable privacy laws. If a customer receives Personal Information through the electronic communications platform, the customer should not disclose such Personal Information unless Deutsche Bank has consented to such disclosure. 6. Internet security and message delay or corruption

The Bank does not guarantee the confidentiality of APAC electronic communications. Such electronic communications may be intercepted or viewed by unauthorized or unintended parties, may not arrive at their intended destination, or may not arrive in the form transmitted. There can be no guarantee that the transmission of APAC electronic communications will be timely, secure, or error-free, and the Bank shall have no liability arising out of any delay, interception or other access by unauthorized or unintended third parties, or technological corruption of any APAC electronic communication. Any information provided to the customer through APAC electronic communications will be valid only as of the date and time when it is sent, and the Bank has not assumed and will not assume any obligation to update any such information or otherwise to notify the customer of any changes to any such information.

7. APAC electronic communications service providers – privacy terms and conditions

The use of APAC electronic communications is also subject to the privacy policy and other terms and conditions of the customer’s agreement(s) with its APAC electronic communications service provider(s) as well as Deutsche Bank’s agreement(s) with its APAC electronic communications service providers. Note in particular that Deutsche Bank has no influence on or control over the terms and conditions of the customer’s agreement(s) with its APAC electronic communications service provider(s) or the type and scope of data that the customer’s APAC electronic communications service provider(s) collect(s), stores or uses as part of the use of this service(s).

8. Information regarding the Bank and supervision as well as further legal information

The Bank draws the customer's attention to the publication of the mandatory information on the Deutsche Bank group and its supervision available at https://www.db.com/disclosures.and the legal information on sales and trading activities (disclaimer) available at https://www.db.com/sales-disclaimer. The Bank also refers the customer to the legal information available at https://www.db.com/legal-resources.

9. Inclusion of terms and conditions of Deutsche Bank

The General Terms and Conditions /Terms of Business of the Bank shall apply to the use of APAC electronic communications, in addition to the terms and conditions described herein. In the event of any conflict, these Terms of Use shall prevail.
